1. ASSUMPTION OF RISK Resident acknowledges that staying at the Western Edition RV Community and participating in activities therein involves inherent risks, including but not limited to risks of personal injury, property damage, weather conditions, natural hazards, wildlife encounters, equipment failures, and actions of other residents. Resident voluntarily assumes all such risks associated with their stay.
2. RELEASE AND WAIVER OF LIABILITY Resident, on behalf of themselves, their heirs, executors, administrators, and assigns, hereby releases, waives, and discharges the Western Edition RV Community, its owners, employees, managers, agents, and affiliates from any and all claims, liabilities, damages, losses, or causes of action arising from personal injury, death, or property damage incurred while staying at or using the Western Edition RV Community’s facilities, except in cases of gross negligence or willful misconduct by the Western Edition RV Community.
3. INDEMNIFICATION Resident agrees to indemnify and hold harmless the Western Edition RV Community, its owners, employees, managers, agents, and affiliates from any claims, demands, losses, liabilities, or expenses (including reasonable attorney fees) arising from Resident’s actions, negligence, or failure to comply with community rules and regulations.
4. COMMUNITY RULES AND REGULATIONS Resident agrees to comply with all rules, regulations, and policies of the Western Edition RV Community. Failure to adhere to community rules may result in expulsion from the premises without a refund.
5. MEDICAL EMERGENCIES Resident acknowledges that the Western Edition RV Community does not provide medical assistance. In case of an emergency, Resident is responsible for seeking necessary medical care. Resident releases the Western Edition RV Community from any claims related to emergency response or medical treatment.
6. DAMAGE TO PROPERTY Resident is responsible for any damages they cause to the Western Edition RV Community property, including but not limited to infrastructure, facilities, and other residents’ property. Resident agrees to pay for any damages caused during their stay.
6A. FIRE SAFETY AND ELECTRICAL SAFETY RULES
Resident acknowledges that fire safety is critical to the health, safety, and welfare of all residents and property at the Western Edition RV Community. Resident agrees to comply with the following fire and electrical safety requirements at all times:
a. Operable and Safe RV Condition
All RVs must be maintained in safe, operable condition, including fully functioning electrical, propane, heating, and cooling systems.
RVs with exposed wiring, faulty electrical systems, fuel leaks, or other unsafe conditions are prohibited from occupying the property.
Management reserves the right to require immediate repair, disconnection of utilities, or removal of any RV deemed unsafe.
b. Prohibited Electrical Equipment and Fire Hazards
The following items and practices are strictly prohibited inside or outside of any RV:
Extension cords used as permanent or semi-permanent power sources
Power strips, surge protectors, or multi-outlet adapters not specifically designed and rated for RV use
Portable electric heaters of any kind
Propane, kerosene, or fuel-powered space heaters
Exposed, modified, damaged, or non-code-compliant electrical wiring
Any appliance, device, or modification that creates a fire, electrical, or safety hazard, as determined by management
Only manufacturer-installed or professionally installed, code-compliant RV appliances and electrical systems may be used.
c. Electrical Connection Standards
RVs must be connected directly to the electrical pedestal using a properly rated RV power cord compatible with the pedestal service.
Daisy-chaining of cords, adapters, or devices is prohibited.
Electrical usage must not exceed the rated capacity of the RV or electrical pedestal.
d. Open Flames and Combustibles
Open flames outside of designated equipment are prohibited.
Fire pits, grills, smokers, or similar devices must be approved by management and used in accordance with posted community rules and local fire codes.
Flammable liquids, fuels, or combustible materials may not be stored outside of approved containers or in unsafe quantities.
e. Smoke Detectors and Fire Prevention
Residents are responsible for ensuring their RV is equipped with functioning smoke detectors and propane/CO detectors as applicable.
Residents must immediately report any fire, smoke, electrical malfunction, or hazardous condition to management.
f. Inspections and Enforcement
Management reserves the right to inspect RVs upon reasonable notice or immediately in the event of a suspected safety concern
Violations may result in written notice, required corrective action, utility disconnection, fines, or immediate removal from the community.
Failure to correct a fire or safety violation promptly constitutes grounds for termination of residency without refund.
g. Liability for Fire or Safety Incidents
Resident assumes full responsibility and liability for any fire, damage, injury, or loss caused by prohibited equipment, unsafe conditions, or failure to comply with fire and safety rules. Resident agrees to indemnify and hold harmless the Western Edition RV Community for any claims arising from such incidents.
7. SEVERABILITY If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
8. GOVERNING LAW This Agreement shall be governed by and construed in accordance with the laws of the state in which the Western Edition RV Community is located.
9. ACKNOWLEDGMENT AND ACCEPTANCE By signing below, Resident acknowledges that they have read and understand this Agreement, accept its terms voluntarily, and agree to be bound by them.
